The lawsuit filed against Neighborhood Garage Door Services, Inc. alleges that from time to time, employees are unable to take off duty meal and rest breaks and are not fully relieved of duty for their meal periods. Allegedly, the company employees are required to perform work as ordered by Employee Retention Services for more than five (5) hours during a shift without receiving an off-duty meal break. California labor laws require an employer to provide an employee required to perform work for more than five (5) hours during a shift with, a thirty (30) minute uninterrupted meal break prior to the end of the employee’s fifth (5th) hour of work and a second uninterrupted meal break when employees are required to work ten (10) hours.
Additionally, the class action lawsuit alleges that DEFENDANT failed to pay all minimum wages due to PLAINTIFF for compensable time worked. DEFENDANT also allegedly failed to pay PLAINTIFF overtime wages for all overtime worked, thereby uniformly resulting in PLAINTIFF being underpaid for all time worked during his employment, including overtime worked.
